1. Introduction

Essy FX (trading as Gilessy Markets Hub, hereinafter referred to as "the Company") provides professional forex account management services, trading education, and market analysis. With over a decade of trading experience, we help investors grow capital through disciplined trading strategies that prioritize risk management and consistent returns.

This document outlines the investment model, client benefits, service terms, and key conditions governing the relationship between the Company and its clients.

These Terms and Conditions ("T&Cs") govern the investment and service provision provided by Essy FX to its clients ("the Investor" or "the Client"). By registering for our services and signing or accepting this document, the Investor agrees to abide by the terms herein.

2. Definitions

• Investor/Client: Any individual or entity registering for services under Essy FX or Gilessy Markets Hub.
• Account: The managed trading account operated on behalf of the Investor for investment packages.
• Capital: The funds deposited by the Investor for trading or investment purposes.
• Profit Share: The agreed percentage of profits allocated to Essy FX for management services.
• Service Type: The specific service selected by the Client (Training, Market Signals, or Investment Package).

3. Services Offered

3.1 Beginner to Pro Trading Training

Our structured mentorship program is designed to guide traders step-by-step from foundational concepts to advanced market execution. This service includes:

• Comprehensive trading education curriculum
• One-on-one mentorship sessions
• Access to trading resources and materials
• Practical market analysis training
• Risk management techniques

3.2 Market Signals & Insights

We provide timely market analysis and trade ideas based on technical confluence, trend structure, and risk control. This service includes:

• Daily market analysis and commentary
• Trading signals with entry and exit points
• Risk management guidelines for each signal
• Market updates via preferred communication channels
• Educational insights on market movements

3.3 Investment Packages

We provide structured investment and managed trading services built on disciplined strategies, professional oversight, and strict risk management. Under this service:

• The Client authorizes Essy FX to trade on their behalf using the deposited capital
• The Client retains ownership of their funds and trading account at all times
• Professional account management with transparent reporting
• Regular performance updates and statements

4. Investment Model (For Investment Packages)

4.1 Investment Duration

The investment shall run for a maximum period of twelve (12) months, after which the agreement shall terminate unless renewed by mutual consent in writing.

4.3 Risk Management and Trading Flexibility

Trading activities shall be conducted at the manager's discretion, without fixed trading days, allowing flexibility in response to market conditions. Capital shall be managed with due care and professional judgment, employing:

• Stop-loss mechanisms to protect capital
• Regular portfolio reviews and adjustments

• Transparent Reporting: Regular performance updates and detailed reporting
• Monthly Statements: Comprehensive account statements for investment packages

• Market Updates: Timely information on market conditions and opportunities
• Capital Ownership: For investment packages, capital always remains under investor ownership
• Professional Support: Dedicated customer support team

6. Payment Terms

6.1 Payment Methods

Payments shall be made via M-Pesa or other approved payment methods. All fees must be paid in full before service activation.

6.2 Service Fees

Service fees vary by package and will be clearly communicated during registration. For investment packages, profit-sharing arrangements apply as per the agreed terms.

The Client acknowledges and accepts all risks associated with forex trading and the services provided. The Company shall not be held liable for losses incurred due to market volatility, economic events, or force majeure circumstances.

8. Termination

8.1 Termination by Either Party

This agreement may be terminated by either party with 30 days' written notice to the other party.

8.2 Effects of Termination

• For investment packages: All open positions will be closed in an orderly manner
• Investor funds and accrued profits will be returned less any applicable fees
• Access to services will cease upon the effective termination date
• The Client remains responsible for any outstanding fees or obligations

8.3 Immediate Termination

The Company reserves the right to immediately terminate services if the Client:

• Breaches any material term of this agreement
• Provides false or misleading information
• Engages in illegal or fraudulent activities
• Fails to make required payments

9. Data Protection & Privacy

The Company is committed to protecting your personal information. We collect, process, and store client data in accordance with applicable data protection laws. Your information will be used solely for:

• Service provision and account management
• Communication regarding services and updates
• Compliance with legal and regulatory requirements
• Improvement of our services

We will not share your personal information with third parties except as required by law or with your explicit consent.

10. Dispute Resolution

10.1 Amicable Negotiation

Any disputes arising from this agreement shall first be addressed through good faith negotiation between the parties.

10.2 Arbitration

If disputes cannot be resolved through negotiation within 30 days, they shall be referred to arbitration under the laws of Kenya. The arbitration shall be conducted in Nairobi, and the decision shall be final and binding on both parties.

10.3 Governing Law

This agreement shall be governed by and construed in accordance with the laws of Kenya.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Company's liability is limited to the fees paid by the Client for the relevant service
• The Company is not liable for indirect, incidental, or consequential damages
• The Company is not responsible for losses arising from market conditions beyond our control
• The Company does not guarantee specific results or profit targets

The Client agrees to:

• Provide accurate and complete information during registration
• Notify the Company of any changes to personal or contact information
• Maintain the confidentiality of account credentials
• Use services in accordance with these terms and applicable laws
• Make timely payments for services rendered
• Inform the Company of any concerns or complaints promptly

13. Amendments

The Company reserves the right to amend these Terms and Conditions at any time. Clients will be notified of material changes via email or through the service platform. Continued use of services after such notification constitutes acceptance of the amended terms.
